1. Acceptance of Terms

3. Use of Service

• Acceptable Use: You agree to use the Service in accordance with these Terms and all applicable laws and regulations. You will not use the Service for any unlawful or prohibited purpose.
• Prohibited Activities: You agree not to:
  • Use the Service to generate or disseminate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Attempt to interfere with, disrupt, or disable the Service or the servers or networks connected to the Service.
  • Use any automated means (such as bots, spiders, or scrapers) to access or collect information from the Service without our express written permission.
  • Violate the intellectual property rights of us or any third party.
  • Transmit any viruses, worms, malware, or other harmful code.
  • Attempt to reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use the Service in a manner that violates the terms of service of any integrated AI model provider.

4. Intellectual Property

• Our Content: The Service and its original content, features, and functionality (including but not limited to software, text, graphics, logos, and designs) are owned by Geekflare and are protected by copyright, trademark, and other intellectual property laws.
• User Content: You retain ownership of the content you generate through the Service ("User Content"). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to access, use, reproduce, process, adapt, publicly perform, publicly display, modify, and distribute your User Content solely for the purpose of providing and improving the Service.
• Feedback: Any feedback, comments, or suggestions you may provide regarding the Service are entirely voluntary, and we shall be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

5. Bring Your Own Key (BYOK)

• Responsibility: If you choose to use your API keys with the Service, you are solely responsible for obtaining and maintaining those keys and for complying with the terms and conditions of the respective AI model provider.
• Security: You are responsible for the security of your API keys. If you choose to save your API key within the app for convenience, we will take reasonable measures to encrypt and secure it, but you acknowledge that no security system is impenetrable. For API keys stored in your browser, you are responsible for the security of your browser and device.
• Usage and Costs: You are responsible for all usage and costs associated with your own API keys. We are not responsible for any charges incurred by your use of third-party AI models through your API keys.

6. Payment and Subscription (If Applicable)

• Subscription Plans: We offer different subscription plans with varying features and usage limits. The fees and features associated with each plan are outlined on our pricing page.
• Billing: By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. You authorize us to charge your chosen payment method for those fees.
• Renewals and Cancellations: Subscription plans may automatically renew unless you cancel your subscription before the renewal date. You can manage your subscription and cancellation settings through your account.
• Free Trial: We may offer a free trial period. If you sign up for a free trial, you may need to provide a payment method, but you will not be charged until the trial period expires. You must cancel your subscription before the end of the trial period to avoid being charged.
• Refunds: We don't issue refunds.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT GENERATED THROUGH THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GEEKFLARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE ONE (1) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Geekflare and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may terminate or suspend your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to, your breach of these Terms. You may also terminate your account at any time. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

13. Changes to Terms

We may modify these Terms at any time. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the revised Terms.
